Terms of Service

These Terms of Service ("Terms") govern your access to and use of easyrealestatedonation.org (the "Site"), operated by Easy Real Estate Donation ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. What We Are (and Are Not)

Easy Real Estate Donation is an independent informational and referral service. We are not a 501(c)(3) tax-exempt organization, we do not solicit donations on our own behalf, and we are not affiliated with, endorsed by, or a partner of any charity listed on the Site unless explicitly stated. Charity listings are provided for informational purposes to help property owners learn about organizations that accept real estate donations.

When you submit our lead form, we may refer your inquiry to one or more 501(c)(3) organizations that accept real estate donations. Any resulting donation transaction is solely between you and that organization.

2. Not Legal, Tax, or Financial Advice

Information on the Site about charitable deductions, capital gains, appraisals, IRS Form 8283, fair market value, and similar topics is general in nature and provided for educational purposes only. It is not legal, tax, accounting, investment, or financial advice. You should consult your own qualified attorney, CPA, or financial advisor before making any donation or relying on any tax position. We make no guarantee that any particular tax treatment will apply to your circumstances.

3. Accuracy of Content

We strive to keep charity listings, contact information, and program details accurate, but we do not warrant that the content is complete, current, or error-free. Listed charities may change their acceptance criteria, geographic focus, or status without notice. Before making any decision, verify details directly with the charity.

4. Eligibility and User Conduct

The Site is intended for users 18 years of age or older. You agree to provide accurate information when you submit a form and to use the Site only for lawful purposes. You will not:

• Submit information about a property you have no legal interest in or authority to discuss;
• Use the Site to harass, defraud, or impersonate any person or organization;
• Attempt to gain unauthorized access to the Site, scrape it at scale, or interfere with its operation;
• Reproduce, resell, or commercially exploit any portion of the Site without our written permission.

5. Lead Form Submissions

By submitting our lead form, you consent to be contacted by us and by the referral partner(s) we route your inquiry to, by email, phone, or text using the contact information you provide. Standard message and data rates may apply. You can opt out of further marketing communications at any time, though messages relating to an active inquiry may continue until your matter is resolved.

6. Intellectual Property

The Site, including its text, graphics, logos, page layouts, and code, is owned by Easy Real Estate Donation or its licensors and is protected by intellectual property laws. Charity names, logos, and marks belong to their respective owners and are used for identification only. We grant you a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use.

7. Third-Party Links and Charities

The Site contains links to third-party websites and information about third-party organizations. We do not control and are not responsible for their content, policies, practices, or any donation transaction conducted with them. Your dealings with any third party — including any 501(c)(3) we refer you to — are solely between you and that party.

8. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that any donation will result in a particular tax benefit, that any charity will accept your property, or that the Site will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Easy Real Estate Donation and its operators, owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site, any referral, or any donation transaction. Our total aggregate liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Easy Real Estate Donation and its operators, owners, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your submissions, your violation of these Terms, or your interactions with any referral partner or charity.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
